Subject:  Glendale’s Indigenous Tree Ordinance

 

 

   Glendale has an Indigenous Tree Ordinance that has resulted in a number of Glendale property owners being served with fines of up to $347,600 for trimming the trees on their property.

   Please answer the following questions:

1.      In light of the above, is it incumbent upon a property owner listing a property containing indigenous trees to inform prospective buyers of the Glendale Indigenous Tree Ordinance?

2.      If the listing property owner does not inform prospective buyers of the Glendale Indigenous Tree Ordinance, does the listing sales person and/or broker have a fiduciary responsibility to do so?
